《All Our Patent Are Belong To You》（我們所有的專利都屬于你們），一文由特斯拉CEO埃隆馬斯克發布。

根據日經新聞與東京分析師公司Intellectual Property Landscape聯合開展的一項專利申請和披露研究，特斯拉從2003年成立到2022年3月份，一共累積580多項專利。

務實來說，特斯拉所稱的“所有專利”只是一個三位數，“屬于”也是一個限縮解釋，“你們”不是所有人，特斯拉和馬斯克的格局有點小。

Elon Musk：《All Our Patent Are Belong To You》 Yesterday， there was a wall of Tesla patents in the lobby of our Palo Alto headquarters。 That is no longer the case。 They have been removed， in the spirit of the open source movement， for the advancement of electric vehicle technology。（弄掉專利墻） Tesla Motors was created to accelerate the advent of sustainable transport。 If we clear a path to the creation of compelling electric vehicles， but then lay intellectual property landmines behind us to inhibit others， we are acting in a manner contrary to that goal。 Tesla will not initiate patent lawsuits against anyone who， in good faith， wants to use our technology。（堅持初心，不互相挖坑） When I started out with my first company， Zip2， I thought patents were a good thing and worked hard to obtain them。 And maybe they were good long ago， but too often these days they serve merely to stifle progress， entrench the positions of giant corporations and enrich those in the legal profession， rather than the actual inventors。 After Zip2， when I realized that receiving a patent really just meant that you bought a lottery ticket to a lawsuit， I avoided them whenever possible。（曾經美好，但美好是別人的；提出專利彩票論） At Tesla， however， we felt compelled to create patents out of concern that the big car companies would copy our technology and then use their massive manufacturing， sales and marketing power to overwhelm Tesla。 We couldn’t have been more wrong。 The unfortunate reality is the opposite： electric car programs (or programs for any vehicle that doesn’t burn hydrocarbons) at the major manufacturers are small to non-existent， constituting an average of far less than 1% of their total vehicle sales。（修建專利護城河，但強者根本瞧不上你） At best， the large automakers are producing electric cars with limited range in limited volume。 Some produce no zero emission cars at all。（傳統強者玩家不和你玩） Given that annual new vehicle production is approaching 100 million per year and the global fleet is approximately 2 billion cars， it is impossible for Tesla to build electric cars fast enough to address the carbon crisis。 By the same token， it means the market is enormous。 Our true competition is not the small trickle of non-Tesla electric cars being produced， but rather the enormous flood of gasoline cars pouring out of the world’s factories every day。（不怕電動車汽車公司競爭，憂慮的是燃油汽車一直生產） We believe that Tesla， other companies making electric cars， and the world would all benefit from a common， rapidly-evolving technology platform。 （電動汽車命運共同體） Technology leadership is not defined by patents， which history has repeatedly shown to be small protection indeed against a determined competitor， but rather by the ability of a company to attract and motivate the world’s most talented engineers。 We believe that applying the open source philosophy to our patents will strengthen rather than diminish Tesla’s position in this regard。（是人才定義技術領先，不是專利定義技術領先）

保護種業知識產權專項整治行動介紹

農業農村部為期半年的保護種業知識產權專項整治行動，嚴厲打擊套牌侵權、制售假劣等違法行為，綜合運用法律、經濟、技術、行政等多種手段，推行全鏈條全流程監管，目前各項整治措施正扎實推進，已初步掌握了一批涉嫌違法犯罪線索，立案了一批套牌侵權、制假售假案件，抓獲了一批犯罪嫌疑人。

農業農村部通過投訴舉報平臺直接受理舉報線索54件，全國已立案400多件。

浙江省偵破侵犯“甬優”系列水稻新品種權案，抓獲犯罪嫌疑人7名，涉案金額157萬元；海南省農業農村西甜瓜種子知識產權保護專項執法，立案6起，查扣涉案種子16000余袋，價值300余萬元；河北破獲特大生產銷售偽劣種子案，涉案金額2000余萬元；河南破獲玉米假種子案，涉案金額300萬元。

同時，安徽、內蒙古和甘肅等地，針對哈密瓜品種侵權、小麥“白皮袋種子”、玉米非法制種等案件線索，正在進行嚴格核查，一經查實，將依法嚴懲。

農業農村部種子市場檢查，強化屬地責任，從嚴打擊套牌侵權等違法行為，確保秋季農業生產用種安全。

近日，將派出4個工作組，前往河北、安徽、湖北、貴州等地開展抽查檢查，通過明察暗訪等形式，推動案件線索查辦，確保整治行動各項舉措落實落地，加快形成打擊假冒偽劣、套牌侵權等違法行為的高壓態勢，堅決讓種業侵權者付出沉重代價。

商標審查協作中心商標審查工作介紹

廣州、上海、重慶、濟南和鄭州商標審查協作中心認真貫徹落實國家知識產權局商標局和地方知識產權部門的部署要求，保障商標審查和服務工作平穩有序開展，2一季度各中心共完成商標注冊實質審查109萬件，平均審查周期穩定在4個半月以內。

審查職責不缺位。

面對疫情帶來的嚴峻挑戰，各中心因地制宜、因情施策，竭盡全力解決審查員返崗困難，做好審查任務統籌，創新業務管理方式，有序推進商標審查工作開展。

廣州、濟南中心統籌制定審查任務和績效考核安排，重慶、鄭州中心采取分崗位、分批次方式，齊心協力把審查工作的影響降到最低。

同時，各中心積極配合商標局規范商標注冊秩序，強化對易產生不良影響的商標注冊申請的監測排查，及時上報有關線索，有效形成打擊不良商標申請的合力。

貼心辦好企業事。

為保障商標業務辦理，各中心織密大廳“安全網”，推行業務“網上辦”，暢通咨詢“遠程端”，做好政策“宣傳窗”。

廣州中心設置先鋒崗，接聽咨詢電話，保持對外咨詢服務8小時不中斷；采取“電話預約指導+電子材料預審+郵寄材料審核”的新模式，實現“質權登記遠程辦”，成功辦理商標專用權質權登記2起，涉及質押融資金額達1.89億元。

上海中心安排專人值班，接受商標業務電話咨詢，確保商標申請受理工作不打烊；開通商標質押綠色通道，助力企業復工融資，已辦結4件質押業務，質押金額10.5億元。

重慶中心遠程連接申請人終端，指導辦理商標業務，“零距離”遠程受理商標申請175件；解答企業疑問，關注商標審查進程。

濟南中心及時發布商標申請辦理公告，推行網上辦理，安排大廳人員值守，加強對生產和服務有關商標申請的業務指導，確保業務咨詢有入口、咨詢問題有答案、后續服務有保障。

鄭州中心對相關緊急來電來函審查事項，依法依規加緊辦理，維護申請人利益。
